Acceptance of Terms

Welcome to Spark.Ai ("Spark," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the Spark.Ai platform, website, and all related services (collectively, the "Service").

By creating an account, joining our waitlist, or using the Service in any way, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.

Service Description

Spark.Ai is a career acceleration platform that provides:

• Job targeting — identifying and mapping companies and roles that match your professional profile.
• Resume and LinkedIn optimization — AI-powered rewriting and keyword tuning to maximize ATS compatibility and recruiter appeal.
• Automated job applications — submitting applications to job platforms (LinkedIn, Indeed, Glassdoor, and employer career pages) on your behalf.
• Career insights and community — connecting you with professionals and providing insider tips for your target companies.

The specific features available to you depend on the service plan you select.

Eligibility

To use the Service, you must:

• Be at least 18 years of age.
• Be legally eligible to work in the jurisdiction(s) where you are seeking employment.
• Provide accurate and truthful information in your profile and application materials.
• Have the legal capacity to enter into a binding agreement.

Your Account

When you create an account, you agree to:

• Provide accurate, current, and complete registration information.
• Maintain the security and confidentiality of your login credentials.
• Promptly update your account information if it changes.
• Accept responsibility for all activities that occur under your account.

You must notify us immediately at support@sparkaijobs.com if you suspect unauthorized access to your account.

Service Plans & Pricing

Spark.Ai offers multiple service plans, including but not limited to:

• Basic Plan — auto-application service with a set number of monthly applications.
• Pro Plan — expanded application volume plus resume rewriting.
• Pro Max Plan — unlimited applications with a dedicated career coach.
• Career Switch, Urgent, and Executive Programs — specialized engagement packages.

Billing & Payments

• Subscription fees are billed on a recurring monthly basis unless otherwise stated.
• Program fees for specialized engagements are billed as described at the time of purchase.
• All fees are in USD unless otherwise specified.
• You authorize us to charge your payment method for all fees incurred.

Cancellation & Refunds

• You may cancel your subscription at any time through your account settings or by contacting us.
• Cancellation takes effect at the end of the current billing period. No prorated refunds are provided for partial months.
• For specialized programs, refund eligibility is subject to the specific program terms communicated at enrollment.

Interview Commitment

Commitment Conditions

This commitment is subject to the following conditions:

• You must provide complete and accurate profile information, including an up-to-date resume and job preferences.
• You must respond to our communications and requests for information within 48 hours.
• Your target roles and salary expectations must be reasonable and aligned with your experience level, as assessed by our team.
• The commitment applies to initial interview invitations (phone screens, recruiter calls, or interview scheduling) — not to final job offers.
• The commitment does not apply if you restrict applications to fewer than 10 companies or a single geographic area with limited opportunities.

"Continue working at no additional charge" means we will continue submitting applications and optimizing your profile at no extra monthly cost until you receive qualifying interview responses.

Your Responsibilities

By using the Service, you agree to:

• Provide truthful and accurate information in all resumes, profiles, and application materials. Spark.Ai optimizes your materials but is not responsible for verifying the accuracy of information you provide.
• Maintain active and accessible accounts on job platforms (LinkedIn, Indeed, etc.) where you authorize us to submit applications.
• Respond promptly to interview invitations, employer communications, and Spark.Ai team messages.
• Comply with the terms of service of all third-party job platforms used in the application process.
• Not use the Service for any fraudulent, misleading, or unlawful purpose.

Authorized Actions

By subscribing to and using the Service, you explicitly authorize Spark.Ai to:

• Access and modify your resume and LinkedIn profile to improve their effectiveness.
• Search for and identify job opportunities matching your criteria.
• Submit job applications on your behalf to employers and job platforms.
• Communicate with recruiters or employers on your behalf as part of the initial application process.

You may revoke any of these authorizations at any time by contacting us or updating your account settings. Revocation may limit our ability to provide certain features of the Service.

Intellectual Property

Our Property

The Service, including its design, code, algorithms, branding, and content (excluding your personal data and materials), is the exclusive property of Spark.Ai and is protected by copyright, trademark, and other intellectual property laws.

Your Content

You retain ownership of the content and materials you provide (resumes, profiles, career data). By using the Service, you grant Spark.Ai a limited, non-exclusive license to use, modify, and distribute your materials solely for the purpose of providing the Service to you.

Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose or to submit fraudulent job applications.
• Impersonate another person or misrepresent your qualifications, experience, or identity.
• Attempt to reverse-engineer, decompile, or extract the source code of the Service.
• Interfere with or disrupt the Service's infrastructure or other users' access.
• Resell, sublicense, or commercially exploit the Service without our written consent.
• Use automated tools (bots, scrapers) to access the Service beyond its intended use.
• Violate any applicable local, state, national, or international law.

Disclaimers

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Spark.Ai disclaims all warranties, express or implied, including but not limited to:

• Warranties of merchantability, fitness for a particular purpose, and non-infringement.
• Any guarantee that the Service will result in job offers, employment, or specific career outcomes.
• Any guarantee of uninterrupted, error-free, or secure operation of the Service.

Limitation of Liability

To the maximum extent permitted by applicable law, Spark.Ai and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, data, employment opportunities, or goodwill.
• Costs of procuring substitute services.
• Any damages arising from your reliance on the Service.

Our total aggregate liability for any claims arising under these Terms shall not exceed the total fees paid by you to Spark.Ai in the twelve (12) months preceding the claim.

Indemnification

You agree to indemnify, defend, and hold harmless Spark.Ai and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

• Your use of the Service.
• Your violation of these Terms.
• Any inaccurate or misleading information you provide.
• Your violation of any third party's rights, including employers or job platform terms of service.

Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if:

• You violate these Terms or engage in prohibited conduct.
• Your account is inactive for an extended period.
• We are required to do so by law.
• We discontinue the Service or any part of it.

Upon termination, your right to use the Service ceases immediately. Sections relating to intellectual property, disclaimers, limitation of liability, indemnification, and governing law survive termination.

You may delete your account at any time by contacting us at support@sparkaijobs.com. We will process your request and delete your data in accordance with our Privacy Policy.

Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising under or in connection with these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.

You agree to resolve disputes on an individual basis and waive any right to participate in class action lawsuits or class-wide arbitration.

Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated by posting the updated Terms on this page and updating the "Last updated" date. We may also notify you via email for significant changes.

Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you must discontinue use of the Service.
